  • Not to introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

5. Disclaimer of Guarantees

Klana Tech provides applications and services to the best of our ability, but we do not guarantee uninterrupted availability, specific performance outcomes, or that our applications will meet all of your specific needs. Application performance may vary based on various factors including internet connectivity, device capabilities, and usage patterns.

6. Limitation of Liability

To the maximum extent permitted by law, Klana Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service, including but not limited to loss of profits or financial losses.

7. Intellectual Property

Klana Tech retains all rights, title, and interest in and to our applications, including all intellectual property rights. This includes our software code, designs, trademarks, trade secrets, and proprietary technologies. Users are granted a limited, non-exclusive license to use our applications in accordance with these terms.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within San Francisco County, California to resolve any dispute or claim arising from these Terms.

9. Dispute Resolution

Most user concerns can be resolved quickly and to your satisfaction by contacting us at support@klanatech.com. In the unlikely event that we are unable to resolve a complaint you may have to your satisfaction (or if we have not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts.

10. Indemnification

You agree to defend, indemnify, and hold harmless Klana Tech Ltd. and its employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of our applications; b) a breach of these Terms, or c) Content you submit through our applications.

11. Termination

We may terminate or suspend your access to our applications immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
